Defects liability period in building construction

The guarantee of perfect completion is the guarantee to which the contractor is held during a one year period (defects liability period) following practical completion. Its requires the building owner to repair any  defects either by means of the snagging list mentioned in the official handover report, or by written notification for those revealed subsequent to handover (practical completion).

Any clause excluding such warranty is not valid or legal. Poor workmanship or work that is non-compliant or not carried out are also subject to this guarantee. If the repairs are not done, the necessary work covered by this warranty may, after formal notice of the problem is unsuccessful, be undertaken at the expense and risk of the defaulting contractor. This warranty does not extend to the work required for maintenance or normal wear and tear.
